HRN – Terms of Service and Conditions
The terms of use govern access to and use of our web sites found at the URLs: www.healthrecoverynetwork.co.uk (the “Site”). By accessing and using a site or sites, you agree to be bound by these terms of use and you should read them carefully before using a site. If you do not agree with any part of the following, please do not use the site(s). The company reserve the right to change these terms of use at any time. Amendments will take effect when shown on our sites.
1. Definitions
“You” and “your” means you, the person entering into this purchase agreement or sales contract with us;
“Your”, “goods”, “products” “services”, means the products and /or services sold on our sites as orders online or package and send to your home or delivery address.
“Healthrecoverynetwork.co.uk” is a “HRN” online trading business”, “the”, “we”, “us”, “our” means Health Recovery Network Ltd whose registered office is at Basepoint Business Centre, Shearway Business Park, Shearway Road, Folkestone CT19 4RH, Kent, England.
“Other goods”, “products” and “services” means products or services offered for sale either as “HRN” or www.healthrecoverynetwork.co.uk or in association with or from our carefully selected partners in the UK.
2. User Obligations
You agree that you will only access and use the sites in accordance with this
Term of use and in compliance with and subject at all times to all applicable laws and regulations in the UK or anywhere subsisting in the world. The company reserve the right without notice at any time and at our sole discretion to suspend or discontinue your access to or use of any of the sites in the event that such access or use would be deemed unlawful under UK applicable law or regulations anywhere subsisting in the world.
You will not directly or indirectly act or omit to act in anyway which may infringe, damage or endanger any intellectual property rights (or any goodwill in connection to) HRN products and services which may now or in the future subsist in any part of the world of us or any third party and will not knowingly permit any other person to do so.
You will provide HRN with personal details as requested by us upon registration (where necessary) including your full name, home address; (billing and delivery address).
You may not in any circumstances do any of the following on or in relation to any of our site(s):
Act in any manner contrary to applicable law or regulations, or in any way that may in our opinion have an adverse effect on the sites or knowingly or recklessly transmit or distribute a virus or corrupt data;
Use any domain name or mailbox name so as to infringe upon the rights of any other person whether in statute or common law, in a corresponding trade mark, name, title or status.
To impersonate or double any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
To hold HRN or any of our third party creditors, contractors liable in relation to the accuracy, reliability, availability and/ or performance of contract, online products or the services offered through the internet on our sites which, you acknowledge, are beyond our control; or
To permit any of the third party to do any of the above.
You agree to use the online products as health care products or medical consumables within the dates as marked on the products.
3. Intellectual Property – inventions copyright and patents
The design of the sites (including graphics, text and other material appearing
on the site, their contents and software are protected by copyright, trademarks and other intellectual property rights which are owned or controlled by us. You agree to comply with all copyright notices, information or restrictions contained in any information accessed through the sites.
You may use the sites solely for corporate / or your own personal use. In no event are you permitted to recreate, re-transmit, re-distribute, publish or otherwise re-produce any of the content therein or that is supplied to you or which appears on the sites in any format to anyone and you may not use any such contents in connection with any business or commercial enterprise.
4. Disclaimer
4.1 Other than any of our products or services supply to you decide to buy or accept on separate terms and conditions exclusive of HRN control or any third party, each site is provided as free service available to internet user and therefore no legal relation are created between you and Health Recovery Network Ltd or its agents or selected partners or any of the third parties as a result of such use.
The company may include information or resources or provide links, including hypertext links, from our sites to other websites, resources, advertisements or sponsorship, either directly or indirectly through the e-partners, which are not under our control. Information contained on the sites which has been provided by third parties, and / or information on any other website which is accessed via “the”, (“our”) sites has not been independently verified or validated by us.
We accept no responsibility for these links and do not endorse their contents and we shall have no liability to you for any failure on the part of the merchant’s or operators’ of the linked site or any of its suppliers to fulfil any obligation owed to you or for any defective product or sub-standard service any of them might supply to you. If you decide to access other websites, you do so completely at your own risk.
a) Prices appearing on our sites including discount, promotions and sale prices
are charge at competitive market prices and vary in accordance with product or services offered on our sites and subject to change or withdrawal without notice. We reserved the right to full compliance of status of terms & conditions.
b) Prices appearing on the sites that are not offered either from us or any of the affiliated third parties are invitation for you to make an offer. Please read the terms and conditions of the relevant product or service before entering into a contractual sale transaction on the site.
c) Sales, discount and promotional prices including free offers (minutes) are subject to terms and condition. Status and minimum offer applies.
4.4 While we take every care to ensure that the standard of “our” (“the”) site remain high, the Internet is not a stable medium and errors, omissions and interruptions may occur at any time. Neither HRN, nor any of its agents give any representation or warranty as to the accuracy, completeness and / or reliability of any content on the sites, or as to any information contained on any website whatsoever which is accessed via “the” or (“our”) sites or as to the fitness of each sites for any particular purpose. HRN and its agents disclaim and exclude to the fullest extent permitted by law all liability for any loss or damage whatsoever arising out of or in relation to your use of or inability to use the site.
We disclaim and exclude to the fullest extent any liability arising from user’s computer system failure, “Cookies” or the closure of browser or the loss of customers’ online “wish-listing facility” through such failure or closure. Inability to use sites correctly or back and forward scrolling which may cause malfunction on user’s system resulting in “inaccessibility of page(s) “browser closure” or URLs: “expired page”.
4.6 We disclaim and exclude to the fullest extent any liability for loss or damage of associated products or services arising from general failure of other suppliers such as affiliated partners, and / or other service providers.
4.7 We disclaim and exclude to the fullest extent any liability for refund or replacement for new ‘products’, online discount ‘voucher’ to customer if and when the transaction of product has been completed at ‘point of sale’ or confirmed on customer’s mailbox with an invoice except for warranties.
4.8 We disclaim and exclude to the fullest extent any liability for secondary action or vicarious claim by users on “our” (“the”) sites.
5. Orders
Orders can be taken via the telephone, email or by site. Every order placed is legally binding and all products must be paid for in full as per our full payment terms.
5.1 Cancellation of order
Once you have placed your order on the www.healthrecoverynetwork.co.uk site, we cannot amend or cancel your order before dispatch. If you decide that you do not want an entire order before it is delivered, you can refuse the delivery so that the item(s) are returned to us and we will refund in accordance with our Refund Policy below. The delivery driver will not be able to take back opened packages at this stage. Alternatively, if you have already taken delivery or opened the packaging, please follow the procedure under ‘Non-faulty’ items below.
5.2 Non-faulty items
Please let us know if you wish to return an item within 28 days of receipt by contacting us using the contact details given in the contact us section of www.healthrecoverynetwork.co.uk/return
You are required to take reasonable care of items and items must return in their same physical state so that they can be re-sold. Please return an item in its original and undamaged packaging (including stickers and seals intact) with all of its components. Due to the hygienic nature of protective clothing, dust masks and respirators; all items that are to be returned must be un-opened and any seal / sticker must remain untouched / unbroken.
If an item is returned undamaged in its original and undamaged packaging, we will offer you a refund in accordance with our Refund Policy below. If you do not return the item as instructed, we may make a charge in respect of the cost of recovering (or attempting to recover) the item.
If you do not return an item after our reasonable attempts to recover it, you will be deemed to have accepted the item, at which point a new purchase contract will be made and you will be charged for your order at the price then set out on the www.healthrecoverynetwork.co.uk site. This does not affect your statutory rights.
5.3 REFUNDS
If you are entitled to a refund, we will refund you as follows:
If you paid by payment card, we will refund you on the payment card.
If you choose to keep some items, we will retain the delivery charge. If the order is non-faulty and a choice made by the buyer, we will retain the delivery charge.
If your original order benefited from promotions or special discounts, we will recalculate the total of your revised order after your refund. If your revised order no longer reaches the promotion/discount spend threshold or means that you are no longer entitled to the promotional offer, the cost of your revised order may increase. Any difference will be deducted from the refund and you may not therefore receive the full price of the item in your refund.
Returns instructions – We hope that you will be happy with your purchase but should you wish to return or exchange an item please contact us for further instructions as to how to return product to us.
6. Liability
6.1 All warranties, conditions, undertaking representations and terms whether expressed or implied, statutory or otherwise are hereby excluded to the fullest extent permitted by law except for our products.
6.2 We void in respect of liability for death or personal injury arising out of negligence or for any fraud or fraudulent misrepresentation, HRN, its agents and all contributors to the sites hereby disclaim and exclude to the fullest extent permitted by law all liability for any loss or damage whatsoever and howsoever incurred including any direct, indirect, consequential, special or secondary loss or damage including any damage to goodwill or property or with respect to loss of online product information, income or profits or any loss of anticipated savings incurred by you, whether arising in tort or in contract or otherwise, and arising out of or in relation to or in connection with your access to or use of or inability to use sites, or any software or content supplied to you in connection with the sites, or any services we provide or make available to you through or in relation to our site (other than as may be expressly set out in separate terms and conditions relating to such services), or in connection with any failure of performance, error, omission, interruption, defect, delays in operation or transmission of computer virus or line or system failure even if HRN or its employees, or agents are advised of the possibility of such damages, losses or expenses.
6.3 Any dealings you have with the third party via the sites are your sole responsibility. Should a dispute arise between yourself and any third party due to use of the site we will use our reasonable endeavours to assist its resolution but the company will not be responsible for any loss or damage suffered as a result or any secondary action brought against it.
7. Variation of Contents
Health Recovery Network ‘HRN’ reserves the right in its absolute discretion at any time and without notice to remove, amend or vary any of the contents which appears on any page of the site.
8. Data Protection
The privacy of your information is very important to us and our privacy policy covers our use of any information you provide. By agreeing to use the site, you accept the terms of our privacy policy available at http://www.healthrecoverynetwork.co.uk/privacy
9. Submissions
All information and material submitted to and accepted by HRN via the sites by way of contributions to surveys, discussions and user reviews shall be deemed to be and shall remain the property of Health Recovery Network. We shall be free to use, edit, appends, copy, reproduce and distribute (for purpose of customers service improvements) and company operational development of any such information and materials. HRN shall not be subject to any obligations of confidence regarding such information or materials except as required by law.
10. Termination of Access
The company reserve the rights in our sole discretion to deny you access to any of our sites or any part of our affiliated sites without notice if you are in breach of these terms and conditionsThe clause 9 is extended to the first or subsequent use of all health care products and services or whichever is applicable.
11. Severability
If any part of our terms and conditions is invalid or not enforceable (including any provision in which we exclude our liability to you), the enforceability of any other part of these conditions will not be affected.
12. Force Majeure
The seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock down, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the seller shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as the seller considers unreasonable, it may, without liability on its part, terminate the contract.
13. Governing law and Jurisdiction
These terms and conditions shall be governed by and interpreted in accordance with English law in the courts of England and Wales and shall have exclusive jurisdiction to resolve any disputes between “you” and “the company”.
14. Complete Agreement
Save in case of misrepresentation or fraudulent concealment, these terms and conditions set out the whole of our agreement relating to use of and access to the site(s). They cannot be altered or changed by you at any time. Nothing said by any staff, or its agents on behalf of HRN, or its subsidiaries should be understood as a variation of these terms and conditions or an authorised representation about the sites or the nature and quality of product displayed online thereon. Health Recovery Network Limited “HRN” shall have no liability for any such representation being untrue or misleading.
